Welcome to Asansa. Please read these Terms and Conditions carefully before using our platform. These Terms govern your use of the Asansa website, mobile applications, and services.
1. Acceptance of Terms
By accessing or using the Asansa platform, website, or mobile applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, hosts, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.
2. Description of Services
Asansa provides an online platform that connects travelers ("Guests") with property owners and experience providers ("Hosts") who offer accommodations, experiences, and related services.
Asansa does not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any listings or Host services. Hosts are independent contractors and not employees, partners, or agents of Asansa. Hosts are solely responsible for their listings and services.
3. User Accounts
To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to:
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Immediately notify Asansa if you discover or suspect any security breaches
Asansa reserves the right to disable any user account at any time for any reason, including if you have violated any provision of these Terms.
4. Bookings and Payments
When you book a listing, you agree to pay all charges for your booking including the listing price, applicable fees, and any applicable taxes.
Payment Processing: All payments are processed through secure third-party payment processors. Asansa does not store your complete payment information.
Cancellation Policy: Cancellation policies are set by individual Hosts and are displayed on each listing. Refunds are processed according to the applicable cancellation policy.
Service Fees: Asansa charges service fees for use of the platform. These fees are disclosed before you confirm a booking.
5. Host Terms
If you list a property or experience on Asansa, you agree to:
• Provide accurate and complete information about your listing
• Maintain your listing and fulfill confirmed bookings
• Comply with all applicable laws, regulations, and tax obligations
• Obtain all necessary licenses, permits, and insurance
• Respond promptly to booking requests and guest inquiries
Hosts are responsible for setting their own prices, availability, and house rules. Asansa reserves the right to remove any listing that violates these Terms or our policies.
6. User Conduct
You agree not to:
• Violate any laws or regulations
• Infringe on the rights of others
• Post false, misleading, or fraudulent content
• Harass, threaten, or discriminate against any person
• Attempt to circumvent any security features of the Service
• Use the Service for any unauthorized commercial purpose
• Interfere with the proper working of the Service
Asansa reserves the right to investigate and take appropriate action against anyone who violates these Terms, including removing content and suspending or terminating accounts.
7. Limitation of Liability
To the maximum extent permitted by law, Asansa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Asansa's total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you have paid to Asansa in the twelve (12) months preceding the claim.
Asansa does not guarantee the quality, safety, or legality of any listings or Host services. You acknowledge that you use the Service at your own risk.
8. Dispute Resolution
In the event of a dispute between users, we encourage you to first contact Asansa's customer support team. We will attempt to help resolve disputes between Guests and Hosts.
If a dispute cannot be resolved through our support process, you agree to first attempt to resolve the dispute through mediation before pursuing any legal action. Any legal proceedings shall be conducted in the courts of Ghana.
9. Changes to Terms
Asansa reserves the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date.
Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
